Administrative Enforcement Order Update
In 2006, the Orange County Certified Unified Program Agency (OC CUPA) issued Administrative Enforcement Orders for facilities that failed to come into compliance.
The goal of an Administrative Enforcement Order is to return a facility to compliance in a timely manner, eliminate the economic benefit of non-compliance, and create a deterrence against future non-compliance.
During the 2006 calendar year, the OC CUPA issued Administrative Enforcement Orders for twelve facilities and collected just over $52,000 in penalties. Administrative Enforcement Orders were issued at both hazardous waste generator and underground storage tank facilities which had incurred a serious violation as defined under the Health and Safety Code.
The OC CUPA issues Administrative Enforcement Orders for Class 1 hazardous waste and tiered permitting violations, major UST violations, and repetitive violations in any regulated program. Businesses which fail to comply with inspection reports in a timely manner may be subject to an Enforcement Order. We encourage facilities to review their inspection reports carefully and address all outstanding issues that have been identified by their inspectors.

CUPA Inspection Program Survey Update
Orange County’s Certified Unified Program Agency inspectors began handing out program surveys to regulated businesses on April 16, 2007. The survey process will continue over the next year to insure all businesses have the opportunity to provide input.

The inspectors will hand a survey and a self-addressed stamped envelope to the business following the annual inspection.

Consumers: Looking to the Environment
Consumers these days are savvy and sustainable production practices can be a key consideration in determining if your business gets the job.
Orange County CUPA, in conjunction with the State Department of Toxic Substances Control (DTSC), offers assistance to businesses in developing P2 ideas and strategies.
DTSC has developed short training videos and fact sheets for paint and body and vehicle repair shops which detail equipment and practical approaches you can utilize to do your part in P2.

You may also be legally required to implement P2 into your business. The DTSC mandates that all Large Quantity Generators of hazardous waste and operators who generate more than 12 kilograms of extremely hazardous waste must do source reduction planning.
As part of the planning process a Summary Progress Report must be submitted to DTSC every four years. Source reduction planning for business is commonly called SB14. If you are subject to SB14, September 1, 2007 is the deadline for submission of the report to DTSC.
So bring up your bottom line, make your workplace safer and do your part in protecting the environment. Implement P2 into your business now.

The County of Orange, in conjunction with the City of Newport Beach, operates a free Bilge Pad Exchange Program to preserve and enhance the quality of the marine environment at Newport Harbor. This exchange program provides conveniently located collection points for used bilge pads and distributes free replacement bilge pads. There are three locations at the Newport Dunes Resort and three locations in Newport Harbor.
The County also began a similar project in Sunset Harbor this year, with a bilge pad exchange site located at Mariners Point Fuel Dock. Please contact Christine Lane at (714) 433-6243 if you would like more information.
How do you measure up?
Pollution Prevention (P2) is no longer just a good idea, it also makes perfect financial sense. The ability to eliminate a waste stream from your process not only positively affects the bottom line; it also makes you a steward of the environment.

Facilities in the county have taken steps toward incorporating P2 into their daily operations. Sterling Collision Center in Tustin seized the opportunity to cut costs by implementing P2 practices, which include:
• Less paint delivered to the facility more frequently to minimize paint
lost through expiration.
• Computerized paint mixing for better accuracy and less material waste.
• Purchase of digital HVLP guns to reduce overspray.
• Accurate portable digital color matching guns to reduce paint waste.
• Use of sealable paint liners to preserve leftover paint for reuse.
• Scheduling cars of the same color to be painted as a batch.
• Reusing leftover paint for use in hidden areas of the car.
• Use of a spray gun cleaner recycling system.
• Separate floor sweeps from hazardous sanding waste.
• Use of a sanding booth to prevent contamination of surrounding areas.
• Future conversion to water borne paints to minimize VOC emissions and
use of water for cleanup.
